A judge in Greene County will make a ruling next week on a change of venue motion made by defense attorney's for a teenager from Republic charged with murdering another teen on New Years Eve.
Attorney David Back is asking the court for a change of judge as well in the case against Gabriel Roche.
Roche, 18, is accused of allegedly slitting the throat of 17-year-old Weston North because he believed the young man was a "snitch" who was working for law enforcement, and he wanted his brother to see someone die and because he was a witness to a felony crime, according to the probable cause statement. Authorities say North was not an informant.

Green County prosecutor Dan Patterson is opposing the change of venue motion, according to online court records.
Circuit Judge Dan Conklin will rule on the motion March 2.

A change of judge has been granted. The ruling for the change of venue motion has been rescheduled for May 11th.

UPDATE 02-28-13:
Greene County Prosecutor Dan Patterson has filed paperwork and intends to seek the death penalty against Roche for Weston's death.
