A city official in Nixa was arrested on June 14th for allegedly driving drunk.

The Missouri State Highway Patrol website says that Brian Hayes, 42, Nixa, was arrested for misdemeanor DWI and driving with no insurance at 1 a.m. in Christian County after he was stopped on Hwy 160 on the south side of the city.

Nixa police chief James Bacon said, "officers contacted me at my home early Sunday morning to make sure they were following department protocol....I supported their decision to contact the Highway Patrol."


Bacon said, "we don't want anyone to accuse us of doing or not doing or job based on who were dealing with.....we're going to do what's appropriate so we're not accused of any conflict of interest."

Hayes was booked into the Christian County jail. However, with no charges being officially filed yet, the jail cannot release the booking photo.

Missouri State Highway Patrol Lt. Terry Moore says that the arrest and incident report have been forwarded to Christian County Prosecutor Ron Cleeks office.

Hayes, who was elected mayor of Nixa in 2008, was released to a sober driver according to the report.
