A judge has ruled that two brothers charged with killing a man from Pottersville last November will stand trial for the mans death.
Jonnathan Graven (left) was bound over for trial today (02-06-09)....his brother Jared "Skip Graven was bound over last month (01-20-09).
Prosecutors say that an alleged fight over meth led to the death of Ricky Johnson.
Johnson's body was found in the back seat of his car after a passerby noticed smoke coming from the garage of a rural farmhouse near West Plains.
Investigators say in the probable cause statement that Johnson was under the influence of prescription medication when he went to lay down in the bedroom of Jared Graven (l).
The document goes on to state that while Johnson was sleeping the Graven brothers allegedly stole meth out of the pockets of Johnson's pants and vehicle, and that when Johnson awoke he confronted the Graven brothers about the alleged theft a fight broke out.
It was during that fight the Graven brothers allegedly "hit and stomped" Johnson, causing his death.
The Attorney General's office in Springfield is now assisting the Howell County prosecutor in the case.
